These Terms of Service ("Terms") cover your use of the Commuteur iPhone app (the "App") and commuteur.com (the "Site"), both run by Commuteur ("we", "us", "our"). By using the App or Site, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the App. If you're under 18, a parent or guardian must review and agree to these Terms for you.
2. Your account
Keep your sign-in details private. You're responsible for activity on your account, so tell us right away if you think someone else is using it. We may suspend or close accounts that break these Terms.
3. Acceptable use
You agree not to:
- Use the App or Site for anything unlawful.
- Reverse engineer, decompile or try to extract the App's source code.
- Send spam, malware or harmful content through the App.
- Interfere with how the App or Site works.
- Earn or redeem Green Points through fake or fraudulent trips.
4. Transit information and third-party services
The App brings together schedules, real-time data, prices and booking options from providers such as NJ TRANSIT, the MTA, Uber, Citi Bike and Avis. We don't run these services and can't guarantee their accuracy, availability, pricing or conduct. Departure times, vehicle positions and fares can change without notice. When you book or ride with a provider, their own terms apply.
5. Green Points
Green Points are earned for eco-friendly trips and have no cash value. They can be redeemed for rewards shown in the App. We may change, pause or end the Green Points program at any time.
6. Payments and wallet
Money added to your Commuteur Balance is non-refundable except where the law requires otherwise. Fares shown in the App are estimates based on provider data and may differ from what a provider actually charges. We aren't responsible for those differences.
7. Intellectual property
The App's and Site's design, graphics, text and code belong to Commuteur or its licensors. Don't copy, distribute or build on them without our written permission. Transit agency names and data belong to their owners.
8. Disclaimer
The App and Site are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't promise they'll be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent the law allows, Commuteur isn't liable for indirect, incidental, special, consequential or punitive damages from your use of the App or Site, including missed connections, late arrivals, fare differences or lost data.
10. Changes to these Terms
We may update these Terms. When we do, we'll change the effective date above. Using the App or Site after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
